Is a solicitor needed for Probate administration?

No you do not need a solicitor to deal with an estate. There is no legal stipulation that requires a solicitor to be involved in order for an estate to be administered. However, dealing with Probate, Wills and estates can sometimes be complicated so it is useful to have some independent advice and someone to carry out the work for you. What do I need to administer probate? How can I get it?

  • If you have been appointed as the executor of an estate, you are unable to undertake any of your duties without a Grant of Probate which proves you are entitled to deal with the estate.
  • Where there is no Will, meaning someone has passed away intestate, then the person wishing to administer the estate must apply for letters of administration, which is similar to a grant of probate, giving you permission to act on the behalf of the person who has passed away in dealing with their assets.

Both of these can be applied for via a probate registry.
